Terms of Service

1. The Service

Who Uses This allows users to describe their professional identity, indicate AI tools they already use, and receive recommendations for other AI tools that may be relevant to them, based on a proprietary dataset of professional identities and applications maintained by Prerefer.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that any information you provide is accurate.

3. Your Inputs

You are responsible for the information you submit to the Service, including your described profession and selected tools (“User Input”). You agree not to submit User Input that is unlawful, infringing, or that you do not have the right to submit. You grant Prerefer a non-exclusive, worldwide, royalty-free license to use User Input as reasonably necessary to operate and provide the Service, including to generate the recommendations you request. We may also use aggregated or de-identified information derived from User Input to analyze usage patterns and improve the Service and our underlying dataset. We do not use your email address as part of our recommendation dataset. We do not use identifiable User Input to train third-party artificial intelligence models unless we clearly disclose that practice and obtain any consent required by applicable law.

4. Recommendations Are Not Guarantees

The Service provides recommendations based on a curated dataset and general patterns of tool usage by profession. Recommendations are provided for informational purposes only, may be incomplete or contain inaccuracies, and do not constitute professional, legal, financial, or technical advice. You are solely responsible for evaluating and deciding whether to use any tool suggested by the Service. The inclusion or recommendation of a third-party application does not constitute a guarantee, certification, or representation by Prerefer regarding its quality, security, legality, availability, suitability, or performance. Prerefer is not responsible for any third-party application referenced or recommended through the Service.

5. Acceptable Use

You agree not to:

• Scrape, crawl, harvest, or otherwise systematically extract data from the Service, including the identity-to-app dataset, without our prior written consent;
• Reverse engineer, decompile, or attempt to derive the underlying dataset, source code, or algorithms of the Service;
• Use the Service to build a competing product or dataset;
• Interfere with or disrupt the integrity or performance of the Service;
• Use the Service for any unlawful purpose or in violation of any applicable law;
• Misrepresent your identity or submit false information to manipulate recommendations.

6. Intellectual Property

The Service, including its design, text, graphics, dataset of professional identities and application mappings, and all other content (excluding User Input), is owned by Prerefer or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service or its underlying dataset. Third-party names, trademarks, logos, and product names displayed through the Service are the property of their respective owners. Their appearance on the Service does not imply affiliation with, sponsorship of, or approval of Prerefer unless expressly stated.

7. Marketing Communications

If you provide your email address and opt in to receive marketing communications, we may send you updates about the Service. You may unsubscribe at any time using the link provided in such communications. See our Privacy Policy for more detail.

8. Third-Party Tools and Links

The Service may reference or link to third-party AI applications and websites that are not owned or controlled by Prerefer. We are not responsible for the content, terms, policies, or practices of any third-party tool or website. Your use of any third-party tool is governed by that tool's own terms and privacy policy. From time to time, the Service may include sponsored placements, affiliate relationships, referral arrangements, or other commercial relationships with third parties. Where required by applicable law, we will clearly identify paid or sponsored relationships.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service or other users. You may stop using the Service at any time.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. PREREFER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RECOMMENDATION WILL BE SUITABLE FOR YOUR PARTICULAR NEEDS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREREFER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PREREFER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE NUMBER OR TYPE OF CLAIMS OR THE LEGAL THEORY ON WHICH THEY ARE BASED, SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS IS AN AGGREGATE CAP ACROSS ALL CLAIMS AND CAUSES OF ACTION, NOT A PER-CLAIM OR PER-INCIDENT CAP. NOTHING IN THIS SECTION SHALL LIMIT OR EXCLUDE LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify and hold harmless Prerefer and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Input, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will update the “Effective Date” above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be deemed a waiver. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prerefer regarding the Service.
